SUMMARY

The Senior Manager, Government Pricing and Commercial Contract Compliance, is responsible for providing management over reporting, compliance, and controls on all federal government pricing programs (including Medicaid, Coverage Gap, 340B/PHS, and VA/FSS), state drug pricing transparency programs, and commercial contracting initiatives.  This role will interface closely with third-party vendors (Cumberland & SPS) and internal stakeholders (Legal, Market Access, Accounting & FP&A) to ensure compliance across all statutory compliance initiatives, and that historical data is accurately reported and analyzed in order to help support the business with gross-to-net forecasting and analysis.

 

ESSENTIAL FUNCTIONS: 

Government Reporting and Compliance:

  • Direct and coordinate all tactical processes for the Government Pricing function including oversight and management of third-party vendors (Cumberland, SPS, etc) responsible for Government Pricing, Rebate and Chargeback processing.
  • Responsible for creation, maintenance and adherence of approved Standard Operating Procedures (SOPs) and Policies related to Government Pricing.
  • Responsible for the timely and accurate calculation, analysis and submission of all mandated Government Pricing to appropriate government agencies including rapid turnaround with robust documentation for compliance support.  Insure required certification of mandated government pricing data by CFO.
  • Manage government contracting obligations under the Center of Medicare & Medicaid Services (CMS), Federal Supply Schedule (FSS) and Public Health Service (PHS) agreements.
  • Lead negotiation and administration of all government contracts from bid to execution. Review and discuss with legal to ensure contracts are within acceptable legal parameters to avoid significant risk or exposure. 
  • Collaborate with internal/external counsel and Government Affairs on a regular basis for matters related to Government Pricing compliance and emerging legislation / trends.
  • Monitor existing legislation and Lundbeck’s Government Pricing policies and procedures to ensure compliance. Examples: Bona Fide Fee for Service/ Fair Market Value, Government Pricing Calculations.
  • Develop and communicate internal controls for presentation and assurance to financial, internal and government auditors.

Contract and Pricing Administration:

  • Collaborate with Managed Markets, Marketing and Sales to understand pricing strategy and potential impact on government programs and commercial contracts. Based on pricing strategy and statutory requirements, assist with modeling and negotiation of commercial contracts.
  • Create effective and compliant processes/controls to track contract terms which enable efficient, error-free administration.  Timely and accurate operational implementation of new contracts to meet deadlines and reporting requirements.  Provide early warning on any significant variances to projected profitability targets or non-compliance issues.
  • Collaborate with Legal to insure contract language interpretation is in compliance with current regulations and Corporate policies including Code of Conduct.
  • Timely update to all states required by new and existing Transparency Laws.  Coordinate appropriate responses and follow up with outside counsel to insure best practice and compliance with all aspects of pharmaceutical manufacturer reporting.
  • Manage outsourced business partners (e.g. Cumberland and SPS) to insure Class of Trade, internal price changes, rebate processing, SOPs, and reporting are in compliance, accurate, and audited at regular intervals to minimize risk of error, misstatement, or fraud.
  • Customer Service Liaison and Lead for inquiries on potential new product shipments and pricing.
  • Manage Customer set-up process for 340B purchases which includes vetting for meeting qualification criteria.
  • Manage 3rd party provider to insure all payments are made on time and accurately.  Verify and approve claims prior to payment

Financial Reporting, Analysis, and Planning:

  • Develop sensitivity analysis for proposed or new federal and state legislative changes and provide potential profitability impact on current and future products. Communicate analysis to key internal stakeholders in executive level presentations.
  • Collaborate with key stakeholders on the gross to net budget and accrual process by providing historical trending, analysis and insight to ensure Government Pricing and Commercial Contracting is accurately identified and considered.
  • Assist in strategic planning efforts for all rebate programs to provide accurate and timely inputs from existing databases to assess financial impact for LTP, acquisition or divestiture of products, and business development.
  • Treasury responsibilities for Lundbeck Employee Political Action Committee (LuPAC)


REQUIRED EDUCATION, EXPERIENCE and SKILLS:

  • Accredited Bachelor’s Degree in Accounting, Finance or other business degree
  • 7+ years work experience related to government pricing and compliance or commercial contract pricing and administration
  • Advanced modeling skills
  • Must possess excellent leadership, communication, and presentation skills aimed at engaging stakeholders at all levels including Senior Management in North America and Denmark.
  • Proven successful track record of internal controls design, risk assessment, and external audits
  • Experience and ability to interpret comprehensive and intricate research documents and apply to current business conditions


PREFERRED EDUCATION, EXPERIENCE AND SKILLS:

  • MBA or CPA

 

TRAVEL

  • Willingness/Ability to travel up to 10% domestically. International travel may be required.
